Terms of Service

1. Agreement

These Terms are between you and Randy Wardlow, Inc. ("EverChase", "we", "us") and govern your use of the EverChase OS web application, iOS application, and everchaseos.com (together, the "Service").

By creating an account or using the Service, you agree to these Terms. If you are agreeing on behalf of a club, company or other organisation, you represent that you have authority to bind it.

You must be at least 18 years old to create an account. No one under 18 may register for an account, administer one, or be given login credentials to one. EverChase is not directed to children.

2. The Service is in beta

EverChase is under active development and is provided on a beta basis. Features may change or be removed, and the Service may contain errors. Do not use it as your only record of anything you cannot afford to lose. Keep independent records of legally required information.

3. Your account

You are responsible for your account credentials and for everything done through your account. Tell us promptly at privacy@everchaseos.com if you believe it has been compromised. Keep your account information accurate.

4. Your data, and information about other people

You own the information you put into the Service. We claim no ownership of it. You grant us only the licence needed to host, process, back up, transmit and display it in order to operate the Service for you.

This section is the important one. The Service lets you record detailed information about people who are not our users and have no account — guests you invite, their phone numbers and email addresses, emergency contacts, guardians of youth members, individuals credited in hunt and harvest records, and people you invoice.

You are responsible for that information. Specifically, you represent that:

If someone asks us to correct or delete information you entered about them, we will refer them to you and expect you to respond. We may act directly where the law requires it.

Information about people under 18. You may record limited information about a person under 18 — a youth member on a roster, a family member, a guest — where it is necessary to manage your property or club. Where you do, you represent that you are that person's parent or legal guardian, or that you have the permission of their parent or legal guardian, and that you have authority to provide their information to us.

During the beta you must not give anyone under 13 their own login, their own email-based profile, a messaging account, or any means of entering information into the Service directly. Anything recorded about a person under 13 must be entered by an adult account holder.

You will indemnify us against claims arising from information you enter about other people, or from your failure to meet the obligations in this section.

5. The Service does not tell you what the law requires

This is not a compliance tool, and nothing in it is legal advice.

EverChase records what you tell it about seasons, harvests, wildlife, burns, chemicals, equipment and people. It does not verify any of it against the law.

You alone are responsible for complying with all applicable hunting, fishing, wildlife, firearm, land use, agricultural, environmental, employment and tax laws and regulations — including season dates, bag and possession limits, tagging, licensing, permits, and any harvest reporting a state or federal agency requires.

Recording a harvest in EverChase does not report it to any agency. Season dates, limits and similar values shown in the Service come from what you or another user entered and may be wrong or out of date.

6. Rules you configure are yours, not ours

The Service lets you define your own harvest rules — minimum antler points, spread, age — and record fines against members who break them. Those rules, the fines and their enforcement are entirely yours. We do not set them, review them, validate them against the law, or take part in enforcing them. Disputes about them are between you and your members.

7. Financial records are records, not payments

Invoices, dues, deposits, expenses, payments and fines in the Service are bookkeeping records only. EverChase does not process payments, hold funds, transfer money or act as a payment service. Money changes hands entirely outside the Service, and marking something paid does not move any funds.

The Service is not accounting, tax or financial advice.

8. Waivers and documents

The Service can store waivers, signature records and other documents you upload. We do not supply the wording of any waiver, and we do not warrant that any waiver stored in the Service is valid, enforceable or sufficient for any purpose. Whether a waiver protects you — including one signed by a guardian on behalf of a minor — is a legal question for your own counsel.

9. Safety, physical risk, and emergencies

9.1 You accept the risk of the activities themselves

Hunting, shooting, climbing into and using elevated stands, prescribed burning, applying chemicals, operating equipment and machinery, handling animals, and land management generally are inherently dangerous activities that can cause serious injury, death, and damage to property.

Using software to plan or record those activities does not make them safer and does not shift any part of that risk to us. You remain responsible for the safety of yourself, your members, your guests, and anyone else on your property.

9.2 Safety-related records are records, not certifications

The Service displays information that people have entered, including stand inspection dates and status, equipment maintenance intervals and service history, burn permits and weather conditions, and chemical application rates.

That information is only as accurate and as current as whoever typed it. We do not verify it, inspect anything, or certify that anything is safe or fit for use.

A stand shown in the Service as inspected, or as active, is a record someone entered — it is not a statement by us that the stand is sound. Maintenance shown as due or not due reflects a schedule someone configured, not an assessment of whether equipment is safe to operate. The Service may highlight, sort or colour such records for convenience; that presentation is not a safety judgement.

Never rely on the Service to decide whether something is safe. Inspect stands, equipment and conditions yourself before use, every time.

9.3 Burning, chemicals, and firearms

Prescribed burning, chemical application and the use of firearms carry particular risk to people, to your property, and to neighbouring property.

You are solely responsible for obtaining permits, observing weather and burn-day restrictions, notifying whoever must be notified, and complying with every applicable law and agency requirement. A burn permit number, weather note, or application rate recorded in the Service creates no permission and has no legal force. For chemicals, the product label governs — where anything recorded here differs from the label or from applicable restrictions, the label and the law control.

9.4 Not an emergency service

EverChase is not an emergency service, a location tracker, or a safety device, and must not be relied on as one.

Emergency contact details stored in the Service are records for your convenience. The Service does not contact anyone on your behalf, does not monitor whether you are safe, and does not summon help.

The Service is designed to work without a signal, but you must not rely on it being able to communicate anything at any given moment. In an emergency, contact emergency services directly.

9.5 Injury, death and property damage

To the fullest extent permitted by law, and subject to Section 15, EverChase is not liable for personal injury, death, or damage to property arising out of activities you plan, record, or carry out in connection with the Service, or out of reliance on any information the Service displays.

10. Offline use and synchronisation

The Service stores data on your device and synchronises when a connection is available. As a result, information you enter may not reach our servers or another user's device immediately, and two people working offline may record conflicting information. We make reasonable efforts to synchronise reliably but do not guarantee that any particular record is transmitted, or transmitted within any period.

11. Acceptable use

Do not: break the law using the Service; upload anything you lack rights to; upload malware; attempt to access another account's data or defeat the Service's access controls; probe or load-test the Service without permission; scrape it; resell or provide it to third parties except as intended; or use it to harass anyone or to record information about people for unrelated purposes.

12. Fees

The Service is currently provided free of charge during beta. If we introduce fees, we will give notice before they apply to you, and you may stop using the Service rather than pay.

13. Termination and getting your data out

You may stop using the Service and close your account at any time by contacting privacy@everchaseos.com.

We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service — with reasonable notice except where a breach or legal obligation makes that impractical.

For 30 days after termination you may request an export of your data. After that, we delete it as described in the Privacy Policy.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that data will not be lost.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERCHASE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL.

OUR TOTAL LIABILITY ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED US DOLLARS ($100) OR THE AMOUNTS YOU PAID EVERCHASE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited — which in many jurisdictions includes liability for death or personal injury caused by negligence, and liability for fraud. Where a limit in this section is not permitted, it applies to the fullest extent that is.

16. Indemnification

You will defend and indemnify EverChase against claims, damages and costs arising from your use of the Service, your breach of these Terms, information you enter about other people, or your failure to comply with any law referred to in Section 5.

17. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict of laws rules.

Any dispute arising out of these Terms or the Service will be brought exclusively in the state or federal courts located in Marion County, Florida, and you and EverChase each consent to the personal jurisdiction of those courts.

18. Changes

We may update these Terms. We will post the updated version and update the effective date, and for significant changes will notify account holders by email before they take effect. Continuing to use the Service after that means you accept the change.
